Safe Work Australia opened a national public consultation on 10 August 2026 seeking feedback on how health monitoring and air monitoring requirements for hazardous chemicals should be clarified under Part 7.1 of the model Work Health and Safety (WHS) Regulations. This consultation runs in parallel with Australia’s broader transition from Workplace Exposure Standards (WES) to Workplace Exposure Limits (WEL), a shift that is already forcing practitioners to revisit exposure benchmarks used in site-specific risk assessments. Developers, landowners and their legal advisers should treat this consultation as an early signal that current site safety documentation, including CEMPs and OEMPs written against ambiguous WES-era triggers, may need revision once reforms land.
Five Proposed Changes to Hazardous Chemical Monitoring
The consultation is examining five specific areas of Part 7.1 of the model WHS Regulations. First, it seeks clearer legal triggers for when health monitoring must be offered to workers exposed to hazardous chemicals, replacing the current reliance on broad professional judgement with more defined criteria. Second, it is reviewing health monitoring exposure thresholds and how biological exposure standards should be applied in day-to-day practice, an area practitioners have flagged as inconsistently interpreted across jurisdictions.
Third, the consultation proposes standardising the reporting framework used when health monitoring reports are provided to state and territory WHS regulators. Currently, reporting formats and timing vary depending on jurisdiction and regulator preference, which creates duplicated administrative burden for national contractors and remediation firms operating across multiple states. Fourth, and most relevant to fieldwork planning, the consultation is defining specific parameters for when quantitative air monitoring becomes a legal requirement, and how that monitoring data should be integrated into site-specific risk management plans rather than treated as a standalone compliance record.
Fifth, the consultation addresses the information registered medical practitioners need to properly oversee health monitoring programmes. This includes exposure history, process descriptions and chemical handling data that practitioners currently supply inconsistently, sometimes leaving medical officers to make monitoring decisions without full context on the hazardous chemicals or contaminated media involved.
These five reform areas sit within Part 7.1 of the model WHS Regulations, which governs hazardous chemicals generally, and interact with the Workplace Exposure Standards for Airborne Contaminants framework currently transitioning to Workplace Exposure Limits. Safe Work Australia has not published draft regulatory text at this stage. The consultation is a feedback-gathering exercise, meaning the specific numeric thresholds and trigger definitions that emerge will depend on submissions received from industry, unions, medical practitioners and technical bodies during the consultation window.

Australian context
Contaminated land practitioners in Queensland, New South Wales, Victoria and South Australia already navigate a patchwork of WHS regulator expectations layered on top of environmental frameworks such as the National Environment Protection (Assessment of Site Contamination) Measure 2013 (NEPM 2013). Schedule B2 of the NEPM sets out site-specific risk assessment guidance, but it does not prescribe occupational air monitoring triggers for field teams undertaking intrusive works. That gap is currently filled by individual consultant judgement, insurer requirements and site-specific safety management plans, which is precisely the inconsistency this consultation is designed to address.
The parallel move from Workplace Exposure Standards to Workplace Exposure Limits adds urgency. WEL values will, in many cases, be lower than existing WES figures for common contaminants encountered on Australian contaminated sites, including benzene, silica dust and several chlorinated solvents relevant to vapour intrusion assessment. If health and air monitoring triggers are recalibrated at the same time WEL values tighten, site teams could see two separate but related shifts hit fieldwork protocols within a similar timeframe. Practitioners preparing Remediation Action Plans (RAPs), Construction Environmental Management Plans (CEMPs) and Occupational Environmental Management Plans (OEMPs) should treat these as connected reforms rather than isolated changes.
State and territory WHS regulators, including SafeWork NSW, WorkSafe Victoria, Workplace Health and Safety Queensland and SafeWork SA, currently apply the model WHS Regulations with jurisdiction-specific guidance material that is not always consistent. A standardised national reporting framework for health monitoring reports would reduce duplicated compliance effort for contractors and consultants operating multi-state remediation programmes, a common scenario for national remediation contractors and larger environmental consultancies. Firms in this position should consider making a submission during the consultation window, as the trigger definitions and reporting formats that emerge will shape fieldwork planning and compliance documentation for years to come.
